PMTA Update 2026: Which Disposable Brands are Still Legal in the US?
The “wild era” of disposable e-cigarettes has finally come to an end. As of March 2026, the US Food and Drug Administration (FDA) and state authorities have moved from issuing warning letters to tough enforcement. For sellers and users alike, the conversation has shifted from “what’s good?” to “what’s not going to be confiscated at the border or fined at the counter?”
According to the FDA’s publicly available database, 41 e-cigarette products have received Marketing Granted Orders (MGOs) from the FDA. They are therefore the only e-cigarettes that may be lawfully marketed and sold in the United States.
So far, NJOY Daily is the only disposable e-cigarette product.

“New Flavor Guidance” Released March 9, 2026

However, on March 9, 2026, a landmark draft guidance was issued by the FDA, entitled “Premarket Tobacco Product Applications for Flavored E-Cigarettes—Considerations Related to Youth Risk.”
The FDA is currently considering “adult-oriented flavors” like coffee and mint, but so far, only tobacco and menthol flavors are officially approved in the e-cigarette market. The sole exception is nicotine pouches like Zyn, whose full range of flavors is still legally allowed.
So, if blueberry is your go-to e-liquid flavor, forget waiting for it to be officially allowed. But if mint-coffee is your thing, then 2026 is your year!
Federal Enforcement Data (Illegal E-Cigarette Seizures)
The FDA and the U.S. Customs and Border Protection (CBP) have carried out various operations against unauthorized ecigarette products:
- In one operation, the FDA and the CBP seized 4.7 million units of unauthorized ecigarette products with an estimated retail value of $86.5 million.
- All the products seized by the FDA and the CBP in this operation lack the necessary FDA premarket marketing authorizations (MGOs) and cannot be legally marketed or distributed in the U.S.
- FDA and CBP announced that to date in the same enforcement year, they have stopped over 6 million units of unauthorized ecigarette products with an estimated total MSRP value of more than $120 million.
